Today, June 26, 2019, circuit judge Denise Ferrero of the Eighth Judicial Circuit of Florida heard a motion made by Union County to dismiss the lawsuit by HPS II. The mine company is demanding nearly 300 million in lost revenue from Union Co. because the county will not issue them a permit to mine.
Union County was represented by David Theriaque of Theriaque and Spain of Tallahassee. It seems that much 0f the case presented by HPS II rests upon the judge’s interpretation of the Bert Harris Act, as applied to the mining company’s endeavors. For that reason, Mr. Theriaque spent a good deal of time explaining why he believed it does not apply in this case.
Each side has 30 days in which to submit their written arguments, after which time the judge will issue a decision.
